Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and the developers of SimpliCut ("we," "our," or "us").
By downloading, installing, accessing, or using SimpliCut on any Android device, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not install or use the application.
License Grant & Scope
Subject to your adherence to these Terms, SimpliCut grants you a revocable, non-exclusive, non-transferable, and limited license to download, install, and execute the application on compatible Android devices owned or controlled by you.
You agree that you will not:
- Decompile, reverse engineer, disassemble, or attempt to derive the source code of SimpliCut, except where permitted by applicable law.
- Rent, lease, lend, sell, redistribute, or sublicense the SimpliCut application package (APK) or any of its proprietary components.
- Modify, circumvent, or disable any security features, technical limitations, or advertisement display mechanisms in the app.
Intellectual Property Rights
All intellectual property rights in and to SimpliCut — including but not limited to the software design, graphical user interface, icons, branding, algorithms, and documentation — are owned exclusively by SimpliCut and its licensors.
SimpliCut utilizes certain open-source libraries and Android system components (such as AndroidX Media3 and Jetpack Compose) subject to their respective open-source licenses (such as the Apache License 2.0). Nothing in these Terms restricts your rights under the applicable open-source license agreements.
User Content & Conduct
SimpliCut is an on-device utility tool. You retain 100% ownership and copyright of all video clips, audio recordings, text titles, and media you import into or generate with SimpliCut. SimpliCut claims no rights, title, or interest in your creative works.
You are solely responsible for all content that you import, edit, render, or distribute using the app. You warrant that:
- You have all necessary permissions, licenses, and rights to use and edit the video, audio, and visual materials imported into SimpliCut.
- Your content does not infringe upon any third party's copyright, trademark, trade secret, privacy, or publicity rights.
- You will not use SimpliCut to produce, edit, or disseminate any material that is unlawful, defamatory, obscene, harassing, threatening, or harmful.
Advertising & Third-Party Services
SimpliCut is provided free of charge and does not impose subscription fees or export watermarks. To support continued development and maintenance, the application displays advertisements powered by Google AdMob.
Third-party advertisements may lead to external websites or services that are not controlled or owned by SimpliCut. We do not endorse or assume responsibility for the content, privacy policies, or practices of any third-party advertisers. "AS IS" Warranty Disclaimer
To the fullest extent permissible pursuant to applicable law, SimpliCut disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that the software will be error-free, uninterrupted, or fully compatible with every hardware codec, device manufacturer, or Android OS skin.
- Warranties regarding the speed, compression efficiency, or output quality of exports on specific mobile chipsets.
Because video encoding is resource-intensive and dependent on individual hardware capabilities, memory, and thermal constraints, you are strongly advised to keep independent backups of all original source media files.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall SimpliCut, its developers, affiliates, or contributors be liable for any indirect, incidental, special, consequential, or punitive damages whatsoever.
This includes, without limitation, damages for:
- Loss of data, deleted or overwritten files, or corruption of video and audio projects resulting from app termination, low memory, or device shutdowns.
- Loss of business profits, goodwill, or project deadlines due to rendering delays or hardware incompatibility.
- Device hardware issues, battery consumption, or system overheating caused by prolonged heavy video processing.
Indemnification
You agree to defend, indemnify, and hold harmless SimpliCut and its developers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your breach or violation of these Terms.
- Any media or content created, edited, exported, or distributed by you using SimpliCut.
- Your violation of any third-party rights, including intellectual property or privacy rights.
Changes to These Terms
We reserve the right to revise or replace these Terms at any time at our sole discretion. When revisions are made, we will update the "Effective Date" at the top of this document.
By continuing to access or use SimpliCut after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you should uninstall the app and cease using it.
